What happens if my ex is dishonest and does not make full disclosure?

If your ex fails to make full and proper disclosure, a written demand is sent to your ex’s solicitor giving a time period for compliance.

If compliance isn’t forthcoming, an application is made to court for an unless order.

The unless order will require disclosure by a certain date. If the order is breached an application can then be made for a penal notice.

If there continues to be no compliance, an application can be made for breach of the penal notice and your ex may be fined and ultimately imprisoned.

Family courts have significant powers to ensure compliance with orders for disclosure.
